Please read the following Terms and Conditions closely before using our Web site (www.mountviewestate.com.au). These terms & conditions are intended for your safety and ease of use of our services. If you agree with these terms and conditions you must ‘tick’ the box on the web-site at the time of your booking to complete the booking. No booking will be processed unless the Terms and Conditions form is ticked.

Accommodation

Booking Conditions:

  1. The client must submit a valid credit card when completing the credit card form. Payments can be made by MasterCard and Visa or Money order. All care must be taken by the client to ensure that the information provided in the credit card form is correct. Mount View Estate takes no responsibility for any incorrect information submitted.

  2. The client must submit a valid email address on the Reservation Form. All care must be taken by the client to ensure that the information provided in the Reservation Form is correct. It is the client's responsibility to advise Mount View Estate if an error in the email address was submitted on the Reservation Form or any other correspondence. Mount View Estate takes no responsibility for any incorrect information submitted.

  3. Once your credit card is processed, we will automatically email your confirmation to you. The confirmation letter will record the dates, options or packages, arrival and departure instructions. Bookings are not confirmed until receipt of full payment on booking. Please ensure you check your e-mail regularly. We accept no responsibility for loss incurred due to automatic cancellation or failure of e-mail delivery.

  4. As a Mount View Estate booking is in real time, it is possible to sell out before the purchase process is completed. If this occurs the customer's search results will expire and the customer will need to begin the search process again. Mount View Estate takes no responsibility for bookings not available during the course of the booking procedure.

  5. All taxes, charges and surcharges are included in the prices listed on the site and will automatically be charged to your credit card.

  6. It is the responsibility of Guests to read all terms and conditions prior to booking.

Keys: Keys can not be issued unless payment in full has been made. Keys are to be collected at Mount View Estate as advised.

Check-in and Check-out Times: Standard check in is 2.30pm on the day of arrival and check-out is 10.30am unless otherwise advised by Mount View Estate. Late check out or early check-in will incur a $30 per hour fee and is dependant on other bookings.

Extras: Breakfast is not supplied to guests as part of their booking with Mount View Estate. A Breakfast Hamper can be ordered by guests upon request for a price determined at the time of ordering.

Arrival: A host will welcome guests and demonstrate how to use equipment. Guests must follow the instructions for using the TV’s, Spas and other electrical equipment at Mount View Estate. Failure to do so may leave guests liable for any damage they cause.

Departure: When guests leave Mount View Estate, they must ensure all doors and windows are locked and the keys are returned and locked safely away in the padlock.

Property damage: Please note that in the event that a property is damaged in a malicious way, or beyond reasonable wear or tear or property is taken or lost during the course of stay or extra cleaning is required or more guests stay that are not included in the package, Mount View Estate reserve the right to retain / charge a reasonable cost for the replacement/repair of the item(s) to the Guest. Should you find the property damaged prior to your stay, please advice our office immediately on 0417357274. Failure to do so will deem you to be totally responsible for the condition of the property on departure. The Guest acknowledges that the credit card used for the booking may be debited and the Guest and/or invoiced.

Security Bond: A $1,000 security bond is required from clients for all bookings. A credit card imprint will be taken from the client and only processed if any damage is sustained or complaints are received regarding noise.  Please note that if at any Mount View Estate security equipment is tampered with or overidden your bond will be forfieted. 

Lock-up: When leaving the premises the hirer must ensure that all the doors and windows are securely locked and all guests have vacated the building. The air-conditioning and equipment must be turned off.

Pool/Spa: Guests are responsible for their own safety and that of their children around the spa and pool area. Please watch children at all times. Guests need to exercise care around the pool area and adhere to safety signs.  NO RUNNING, NO DIVING, NO CARELESS BEHAVIOUR is allowed near or around the pool area. Guests must not wear rubber soled shoes around the pool area as when wet, the surface is slippery. NO GLASS is permitted near or around the pool area. Coloured beer bottles are accepted. If glass is broken near this area guests must inform the manager asap. The hirer will need to pay a pool cleaning cost of $4000.

Bushwalking: It is strongly advised that guests do not go bushwalking around the property due to dangers from wildlife and/or the terrain i.e. snakes and uneven ground surfaces. If guests choose to go bushwalking they do so at their own risk.

Music: No loud music is allowed after 11.00pm. The music level must be kept below ‘8’ (or no louder than 80 Decibels) before 11.00-pm. Between 11.00pm -1.00am, the music level must be kept below ‘5’ (or no louder than 60 decibels). NO MUSIC IS ALLOWED AFTER 1.00AM. At all times the hirer and guests should be considerate of our neighbours and keep noise to a minimum. If neighbours complain of loud music, the clients bond will be forfeited.   Please note that if at any Mount View Estate security equipment is tampered with or overidden your bond will be forfieted. 

Tobacco and alcohol: Smoking is not permitted inside the house. Drugs are strictly forbidden on the premises. The hirer will be responsible for any events rising form the illegal use of drugs.

Cleaning & Linen Charges: Additional cleaning and linen changes can be arranged at a small additional charge. It is expected that guests leave the premises in a reasonably clean state before leaving. A cleaning checklist will be supplied on check in for guests to follow. Failure to do so will incur extra cleaning fees of $50 per hour. For bookings of seven days or more, and at the clients request with prior arrangement bedding can be changed at no additional cost midway through your stay.

Travel Insurance: Mount View Estate strongly recommends travel insurance as it may protect you if you cancel your holiday due to unforeseen circumstances.

IF YOU WISH TO MAKE CHANGES TO YOUR BOOKING YOU MUST DO SO VIA EMAIL OR PHONE MOUNT VIEW ESTATE. YOUR AMENDMENT WILL BE CONFIRMED VIA EMAIL AND WILL NOT BE VALID WITHOUT THIS CONFIRMATION.
 
  1. Should any accommodation booking be varied by the Guest charges may apply. If a booking is changed more than 45 days of arrival a handling fee of $ 25 applies.

  2. Should any bookings be varied not more than 45 days and less than 14 days of arrival. (subject to availability), a handling fee of $ 50 applies.

  3. Should any bookings be varied less than 14 days of arrival date there will be a $150 handling fee.

  4. If the tariff is reduced by more than 30%, an extra charge of 12% of the difference between the original tariff and the new tariff will apply.

  1. Mount View Estate reserve the right to cancel a booking at any stage.

  1. You may only use this Site to gather information on Mount View Estate and to make legitimate bookings for Mount View Estate and shall not use this Site to make any speculative, false or fraudulent transactions.

  2. It is against the law to place a booking in a false name or with an invalid or fraudulent credit card. Please be aware that even if you do not give us your real name, your Web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.

Email: We encourage you to share your comments and questions with us. By sending us a testimonial, you agree to have it along with your name posted for public viewing with Mount View Estate.

Privacy: You confirm that you have read Mount View Estate Privacy Policy, the terms of which are incorporated herein, and agree that the terms of such policy are reasonable and satisfactory to you.

Governing Law: These Terms and Conditions are covered in all respects by the Law of Victoria and any legal action arising under the contract shall be litigated only in the appropriate Court having jurisdiction in Victoria.

Disclaimer: Mount View Estate makes its best efforts to ensure that all the information that appears on its website is accurate. However, Mount View Estate does not accept liability for any errors and/or omissions and reserves the right to change the information published at any time and without notice.

Changes to these Terms and Conditions: Mount View Estate has the authority and the right at any time it sees fit to change or modify all or any part of these terms and conditions.

Mount View Estate do not accept any responsibility for Failure or Interruption of Utilities and Essential Services but shall make every effort to contact the authorities to report such incidences. Furthermore, in the event that a faulty appliance is reported Mount View Estate do not accept any responsibility.

Booking Conditions:

  1. The client must pay a 30% deposit when booking a function at Mount View Estate to secure the booking. $500 of this deposit is non-refundable. A booking is not considered confirmed until the deposit has been made.

  2. The balance of the tariff is due on the day of the booking, unless a day previous to this is requested by the customer.

  3. A $1,000 security bond is required from clients for all bookings. A credit card imprint will be taken from the client and only processed if any damage is sustained or complaints are received regarding noise.   Please note that if at any Mount View Estate security equipment is tampered with or overidden your bond will be forfieted. 
  4. All taxes, charges and surcharges are included in the prices.

  5. It is the responsibility of Guests to read all terms and conditions prior to booking.

  6. Mount View Estate reserves the right to refuse bookings.

  7. We hold the proposed date for 7 days from the date given at time of the booking. If the booking has not been confirmed by this time we will consider the date not to be required.

Amendment to Function Booking Policy:

Liability: Mount View Estate does not accept responsibility for any loss or damage to client's effects whatsoever, including effects brought on to or left at the venue. Clients will be held financially responsible for any loss or damage incurred by themselves, their guests or contractors before, during or after the function.

Rules:

  • A maximum of 90 sit down guests and 130 cocktail are allowed at the venue.

  • All persons hiring the premises must comply with relevant legislation for example Occupational Health and Safety and Child Protection Legislation.

  • The premises cannot be sub-let and must be used for the purpose stated.
No Glassware: No glassware is permitted for functions, weddings and conferences. (Coloured beer bottles are accepted).

 

Clean up for Clients:

  • If clients have opted to clean up after their function themselves, they must clean according to the Client Cleaning Checklist provided to them by Mount View Estate management. This includes washing and drying the glasses provided, wiping down benches, tables and chairs after use, cleaning any other equipment used such as BBQ and completing the other requirements listed on the cleaning checklist. Failure to do so will attract a $30 per hour clean up fee to the client charged by management.

  • The venue, furniture and kitchen must be left in a clean and tidy condition. If cleaning is required, a $30 per hour fee will be charged.

Client’s Caterer:

  • The client’s caterer is expected to sign and adhere to the Caterers Cleaning Checklist provided by Mount View Estate. It is the client’s responsibility to make sure this form is signed and given to the property manager on the day of the booking. The caterer must clean all Mount View Estate glassware and any other equipment belonging to Mount View Estate used by the caterer. Failure to do so will attract a $30 per hour clean up fee to the client charged by management.

  • If guests are organising their own catering they have to ensure that their caterer is registered and has insurance to cover the function. It is a policy of Mount View Estate that all caterers have their own insurance. No caterer will be allowed to utilise the premises if they don’t have insurance with public liability.

Guests:

  • It is the responsibility of the client to ensure guests are made aware of the possibility of pre-arranging bus services and bookings for taxi services. Mount View Estate cannot guarantee availability of Taxi services.

  • Guests of the function are not permitted to enter the house. Only the guests who are staying at Mount View Estate for accommodation and catering staff are permitted in the house. The hirer is liable for any damage sustained to Mount View Estate property by either themselves or their other guests during their stay.

Smoking Guests: Please ensure all guests use the ashtrays provided at the venue. Do not allow guests to butt cigarettes on the ground. This causes staining on the paving paintwork. Clients are liable for any damage caused by guests by not using ashtrays. We suggest to inform guests of this at your function. Smoking is not permitted inside the house.

Car Park: The car park can hold no more than 40 cars. Clients must not park more then 40 cars at Mount View Estate.

 

Use of Alcohol and Drugs:

  • The Mount View Estate bar cannot be used for selling alcohol unless the service provider has a licence to do so. i.e a licensed caterer or licensed bar business. If the hirer wishes to supply their own alcohol to guests they must not sell it. Only a licensed premises can sell liquor.

  • The hirer of Mount View Estate has a duty to serve alcohol to guests in a responsible manner.

  • Intoxicated guests must be refused service of alcohol.

  • Guests under the age of 18 years old are not permitted to drink. It is the responsibility of the hirer to ensure this law is not broken.

  • Mount View Estate takes no responsibility for guests who hold a full licence and take it upon themselves to drive a vehicle whilst over the legal blood alcohol limit. (.05 BAC)

  • Drugs are strictly forbidden on the premises. The hirer will be responsible for any events rising form the illegal use of drugs.

  • Drinking at functions is not permitted inside the house which should be not accessible for function guests. The house should only be accessible for guests staying at the property. The hirer will be responsible should any damage be sustained to the house by another guest.

Equipment:

  • Mount View Estate will provide trestle tables and chairs. We have 20 trestle tables (each can seat 6 people) and 100 chairs. Any extra would need to be hired. Table decorations are at client’s own cost.

  • All breakages and damages to property, caused by function guests, will be charged to you at replacement cost. Mount View glassware is $4 per item if broken (these are not glass but hard plastic).

  • Prior to the event the hirer/user must specify all the equipment that will be required and make themselves familiar with the equipment. If technical support is required guests may call 0417357274.

Decorations:

  • Confetti, glitter, or any other similar material cannot be used in or around the building.

  • Use of decorations of any kind is to be approved of by management. This includes candles, rice, petals, ornaments, lights, streamers, balloons, etc.

Entertainment:

  • No dancing on decking below the pool with high heels. This damages the platforms. The hirer will be liable to pay for repairing the platforms if it is found damaged.

  • All entertainment is to be pre approved in writing by management. DJ's and Bands with amps and drums are not permitted at any time.

  • No loud music is allowed after 11.00pm. The music level on the outside stereo must be kept under ‘8’ (or no louder than 80 decibels) for all zones. From 11.00pm-1.00am the music level must be kept under ’5’ (or no louder than 60 Decibels). NO MUSIC IS ALLOWED AFTER 1.00AM.  At all times the hirer and guests should be considerate of our neighbours and keep noise to a minimum. If neighbours complain of loud music, the client’s bond will be forfeited.   Please note that if at any Mount View Estate security equipment is tampered with or overidden your bond will be forfieted. 

Security:

  • Mount View Estate will provide 1 staff member for security on the day of your function from approximately 7pm until the function ends (functions must finish no later then 1am)

Lock up: When leaving the premises the hirer must ensure that all the doors and windows are securely locked, all guests have vacated the building and all equipment, air- conditioning, heating has been turned off.

Please note that all prices and services quoted in this document are done under the present Australian Government Taxation laws, include Goods and Service Tax as presently understood, but are subject to any change in government taxation policy.
